Terms of Service of "Kiss & Cry"

1. General

These terms govern the use of the Kiss & Cry mobile app and the website kisscry.com (“the service”).
The service is provided by Andrei Davidchyk, operating a sole proprietorship under the name Andrei Davidchyk, NIP 5842806930, email andrey.davidchyk@gmail.com.
Using the service is free of charge. By using it you accept these terms. How personal data are processed is described in the Privacy Policy.

2. What the service offers

• figure skating competition results, protocols and calendars
• skater and club pages
• rankings and statistics — the Kiss & Cry rating is calculated by us and is not an official ranking of any federation
• a feed and notifications about the skaters and clubs you follow

The results come from data published by the Polish Figure Skating Association (PZŁF), the International Skating Union (ISU) and competition organisers. The service is not an official resource of those organisations, and the information in it is for informational purposes only.
We take care to present the results correctly, but they may contain errors or differ from the source. If you find one, write to us.

3. Accounts

• On first launch the app creates a guest account. You can also register with an e-mail address and a password.
• A person under 13 may register and claim a skater profile only with the consent of a legal guardian, who is responsible for that use of the service.
• Keep your password to yourself; you are responsible for what is done from your account.
• You can delete your account at any time — in the app or by writing to us, as described at kisscry.com/en/delete-account.

4. Claiming a skater profile

• A skater profile may be claimed only by the skater themselves or by their parent or legal guardian.
• We review each request, and each change to the profile, before it takes effect. We may refuse a request, and we may unlink an account from a skater if the link turns out to be unjustified.
• If we approve a claim to a profile already linked to another account, the profile passes to the account that claimed it, together with everything added to it, and the other account is unlinked.
• By adding a picture or a link, you confirm that you have the right to publish it, including the consent of the people shown in a picture or of their legal guardians.
• Competition results are not part of the profile and cannot be changed by it.

5. Messages

Messages are not public: they are visible to the participants of the conversation. Do not send content that is unlawful, offensive or harassing, that violates the rights of others, or that is unsolicited advertising. We may remove such content and block the account that sent it.

6. What is not allowed

• interfering with the operation of the service or bypassing its security
• downloading data from the service automatically or in bulk
• posting content that violates the law or the rights of others

We may remove content and block an account that breaches these terms.

7. Liability

To the extent permitted by law, we are not responsible for:

• errors in competition results and in the data they come from
• decisions made on the basis of information in the service
• breaks in the availability of the service
• the actions of other users and of third parties

8. Intellectual property

The design of the app and the website, the rankings and the statistics are the property of the service provider. Copying or distributing them without consent is prohibited.
Competition results are facts published by their organisers, and these terms do not claim them as ours.

9. Changes and final provisions

We may update these terms. The current version is always published at kisscry.com/en/terms, with the date it took effect.
These terms are governed by Polish law. Nothing in them limits the rights of a consumer under mandatory provisions of law.
